Employee’s prolonged state of stress makes it difficult for the employee to perform his or her job duties and may appear as underachievement. In order to employer to be able to effectively prevent and intervene the employee’s underachievement, employer should understand the factors behind the underachievement. An employee's underachievement may signal of employee's overload or other problems in the workplace, in which case the employer has a duty to act in accordance with the Occupational Safety and Health Act to eliminate the load factors.
In order to underachievement to be a ground for termination of the employment contract, it must be possible to attribute it to the employee. If the underachievement can be attributed to the employee, the employer has the right to warn and, under certain conditions, terminate the employment contract.
